1. Introduction

Welcome to IMAV Learning Academy Private Limited (“Company”, “IMAV”, “We”, “Our”, “Us”).

These Terms and Conditions (“Terms”) govern your access to and use of our website, services, live online courses, recorded courses, digital materials, and related educational services (collectively referred to as “Services”).

By accessing, registering, purchasing, or using our Services, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must not use our Services.

2. Eligibility

By using our Services, you confirm that:

  • You are at least 18 years old, OR
  • You are a parent or legal guardian purchasing on behalf of a minor.
  • All information provided during registration is accurate and complete.

We reserve the right to suspend or terminate accounts if false or misleading information is provided.

3. Nature of Services

IMAV provides:

  • Live instructor-led online courses
  • Recorded self-paced courses
  • Digital learning resources
  • Batch-based structured academic programs

All services are delivered digitally. No physical goods are shipped.

4. Account Creation & Login Credentials

4.1 Payment Confirmation

Course access is granted only after:

  • Bank confirms payment deduction, AND
  • Our system generates a confirmation receipt.

4.2 Login Credential Creation

Since live courses require manual batch allocation and teacher mapping:

  • It may take up to 48 hours after payment confirmation to create login credentials.
  • Student will be mapped to an available batch and assigned teacher.

If login credentials are not received within 48 hours, the user must contact us via:

  • Live Chat
  • Official Email
  • Official Contact Number

5. Use of Login Credentials

  • Login access is strictly for single-user use.
  • Sharing credentials is strictly prohibited.
  • Any login activity will be considered service consumption.

If login credentials are used to access the course, it is deemed that the service has been utilized.

6. Payments & EMI Facility

  • Payments are processed via authorized third-party payment gateway providers.
  • We do not store full card or banking details.

EMI / Installment Options

We may offer EMI options through third-party banking or financial institutions.

  • EMI approval is solely determined by the financial institution.
  • Approval is subject to customer’s CIBIL score and financial eligibility.
  • IMAV has no control over EMI approval or rejection decisions.

7. Refund & Cancellation Policy

7.1 Refund Eligibility Window

  • Refund request must be raised within 48 hours of purchase.
  • Timestamp will be determined by:
  • Bank payment confirmation, AND
  • System-generated receipt.

7.2 Mandatory Refund Process

  • Refund requests must be submitted ONLY through Live Chat Support.
  • Requests via phone, email, or social media will not be considered valid claims.
  • Our support team will verify eligibility.

7.3 No Refund After Course Access

If login credentials are used and course is accessed (by student, parent, or any user), no refund will be provided.

7.4 Cancellation Charges

If cancellation is approved within 48 hours and course has NOT been accessed:

  • 7% platform processing fee will be deducted.
  • Remaining amount will be refunded.

After 48 hours, no refund or cancellation will be allowed.

8. Strict Anti-Chargeback Policy

Users agree not to initiate chargebacks or payment disputes without first contacting IMAV support.

If a chargeback is initiated without valid grounds:

  • Account access will be immediately suspended.
  • Legal recovery proceedings may be initiated.
  • User will be liable for dispute fees, legal costs, and administrative charges.
  • Future access to services may be permanently blocked.

Fraudulent chargebacks may be reported to financial institutions and credit bureaus.

9. Intellectual Property Rights

All content including but not limited to:

  • Course videos
  • Live sessions
  • Recordings
  • PDFs and study materials
  • Website content
  • Branding, logos, graphics

are exclusive intellectual property of IMAV Learning Academy Private Limited.

Users may NOT:

  • Record sessions
  • Copy content
  • Distribute materials
  • Resell content
  • Upload content elsewhere
  • Share access credentials

Legal action may be taken for infringement.

10. Students, Parents & Users Responsibilities

Users agree:

  • Not to disrupt classes.
  • Not to engage in abusive behavior.
  • Not to misuse platform access.
  • Not to impersonate others.

Violation may lead to account suspension without refund.

11. Freelancers, Marketing Agents, Campus Ambassadors, Partners & Influencers

Any individual or entity representing IMAV in marketing or promotion:

  • Acts as an independent contractor.
  • Is not authorized to make legally binding commitments.
  • Cannot alter pricing, refund terms, or policy terms.

IMAV is not liable for unauthorized promises made by third-party promoters.

All commissions are governed by separate written agreements.

12. Limitation of Liability

IMAV shall not be liable for:

  • Internet connectivity issues
  • Device incompatibility
  • Third-party technical failures
  • Payment gateway downtime
  • Banking delays

Total liability shall not exceed the course fee paid.

13. Dispute Resolution (Mandatory)

13.1 Mandatory Mediation

Before initiating arbitration or court proceedings:

  • Parties must first attempt resolution through mandatory mediation.
  • Written notice must be provided.
  • A 30-day resolution period will apply.

14. Arbitration Clause

If mediation fails:

  • Disputes shall be resolved by binding arbitration.
  • Arbitration shall be conducted in Mumbai, Maharashtra.
  • Governed under Arbitration and Conciliation Act, 1996 (India).
  • Proceedings shall be conducted in English.
  • Arbitrator shall be appointed mutually or by court as per law.

Decision of arbitrator shall be final and binding.

15. Governing Law & Jurisdiction

These Terms are governed by laws of India.

Subject to arbitration clause, courts in Mumbai, Maharashtra shall have exclusive jurisdiction.

16. Termination

We reserve the right to suspend or terminate accounts if:

  • Terms are violated
  • Fraudulent behavior is detected
  • Payment disputes are improperly initiated

17. Modifications

IMAV reserves the right to update these Terms at any time. Continued use of Services implies acceptance of updated Terms.
